This clause covers information on the processing of personal data by RP TradeGroup Sp z.o.o with its registered office in Kraków 30-554, at ul. Zamknięta 10/1.5, entered into the register of entrepreneurs of the National Court Register under the number KRS: 0000793365, NIP: 5213870495, REGON: 383797059, in a fully or partially automated manner and in a manner other than automated personal data constituting or intended to constitute part of a data set, required by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as “GDPR”. The clause is addressed to natural persons who are contractors or potential contractors of the Entrepreneur, representatives, employees or persons designated for contact by specific entities or other stakeholders and correspondents of the Entrepreneur.

  1. Personal data administrator

The administrator of your personal data is RP TradeGroup Sp z.o.o with its registered office in Kraków 30-554, at ul. Zamknięta 10/1.5, entered into the register of entrepreneurs of the National Court Register under the number KRS: 000079336, NIP: 5213870495, REGON: 383797059.   1. Processing of personal data of “representatives” (including employees, persons representing a given entity/person, including proxies, persons designated for contact or providing information, or performing specific tasks) of the following entities:
  • contractors or potential contractors of the Entrepreneur,
  • organizational units, legal/physical persons or other entities cooperating with the Entrepreneur on a basis other than a contract,
  • entities from the business environment of the Entrepreneur,
  • other entities contacting the Entrepreneur in any matter,
  • personal data of persons who are correspondents in their own case, other than current or potential contractors.
  1. If you are a “representative” or a person referred to in point II above, we process your personal data on the basis of Art. 6(1)© of the GDPR, in order to fulfill legal obligations or on the basis of Art. 6(1)(f) of the GDPR, i.e. for purposes resulting from our legitimate interests, consisting in conducting business activity, and this, depending on the circumstances of a given case, among others for the purpose of:
  • communication and handling correspondence,
  • establishing or maintaining contacts related to the subject of the Entrepreneur’s activity,
  • presenting an offer or considering a received offer or establishing cooperation in another way,
  • concluding a contract and performing actions preceding its conclusion, such as: negotiations, exchange of documents,
  • related to the performance of a contract concluded with a contractor,
  • document circulation,
  • performing required actions before competent authorities, including public administration,
  • determining or pursuing possible claims or defending against such claims.
  1. If we did not obtain personal data directly from you, they come from the entity on whose behalf you act or from the party to the contract concluded with the Entrepreneur, or from publicly available registers/databases, including the National Court Register, Central Register and Information on Economic Activity, Public Information Bulletin or websites.

In case of obtaining data in a way other than directly from you, we may process the following categories of personal data: basic identification data, including name and surname, identification data granted by public authorities, electronic identification and location data, address data, contact data (e-mail address, telephone number), data concerning place of employment and position held or function performed, professional qualifications held or other data provided to the Entrepreneur in connection with cooperation or contact.

  1. Personal data processed on the basis of the legitimate interest of the Entrepreneur will be stored until its cessation, in particular for the time necessary to secure information in case of legal need to prove facts or until the limitation period for potential claims expires.
  2. The recipients of data may be:
  • persons authorized by us to process data within the scope of their official duties,
  • other entities if it will be necessary for us to fulfill obligations arising from concluded contracts or legal provisions, including properly perform a service or use our rights,
  • entities providing postal and courier services, banks, insurers, tax advisors, law firms,
  • entities to whom we have commissioned services related to personal data processing,
  • courts and public authorities to whom the Entrepreneur is obliged or authorized to provide your data.
  1. You have the right to access your personal data, the right to request rectification and completion of personal data, the right to request deletion of personal data, in the event of circumstances indicated in Art. 17 of the GDPR, the right to request restriction of processing of personal data, in cases indicated in Art. 18 of the GDPR, the right to transfer your personal data, which we process in an automated manner on the basis of a contract or consent, the right to object and the right to lodge a complaint with the supervisory authority dealing with personal data protection, i.e. the President of the Office for Personal Data Protection.
  2. You have the right to object to the processing of your data for purposes resulting from our legitimate interests.
  3. Providing data is voluntary, but necessary to achieve the purpose for which they are processed. In some cases, providing personal data is a statutory or contractual requirement.
  4. In terms of processing your data, there will be no automated decision-making, including profiling.
  5. We do not transfer your data outside the EU/European Economic Area.

III. Processing of personal data of natural persons who are contractors or potential contractors

  1. If you are our contractor or potential contractor, we process your personal data on the basis of Art. 6(1)(b) of the GDPR for the purpose of concluding a contract and performing actions preceding its conclusion, such as: negotiations, exchange of documents or for the purpose of performing a contract or on the basis of Art. 6(1)© of the GDPR for the purpose of fulfilling obligations specified in legal provisions, including tax provisions or Art. 6(1)(f) of the GDPR for purposes resulting from our legitimate interests, consisting in operating our enterprise and conducting business activity, in particular, depending on the circumstances of a given case, for purposes:
  • communication and handling correspondence,
  • establishing or maintaining contacts related to the subject of the Entrepreneur’s activity,
  • presenting an offer or considering a received offer or establishing cooperation in another way,
  • concluding a contract and performing actions preceding its conclusion, such as: negotiations, exchange of documents,
  • related to the performance of a contract concluded with a contractor,
  • document circulation,
  • performing required actions before competent authorities, including public administration,
  • determining or pursuing possible claims or defending against such claims.
  1. If we did not obtain your data directly from you, these data come from publicly available registers/databases, including National Court Register, Central Register and Information on Economic Activity, Public Information Bulletin or websites. Your data obtained for the purpose of concluding and performing a contract will be stored until the end of the limitation period for any claims arising from it, data processed in our legitimate interest until its cessation, in particular for the time necessary to secure information in case of legal need to prove facts or until the limitation period for potential claims expires, while data processed for the purpose of fulfilling a legal obligation for the period resulting from legal provisions.
  3. The recipients of data may be:
  • persons authorized by us to process data within the scope of their official duties,
