This clause covers information concerning the processing of personal data by RP TRADEGROUP SP Z.O.O with its registered office in Kraków 30-554, at ul. Zamknięta 10/1.5, entered in the Register of Entrepreneurs of the National Court Register under the number KRS: 0000793365, NIP: 5213870495, REG: 383797059, in a fully or partially automated manner and in a manner other than automated, personal data constituting or intended to constitute part of a data set, as required by the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as “GDPR”. The clause is addressed to individuals who are contractors or potential contractors of the entrepreneur, representatives, employees, or contact persons of certain entities or other types of stakeholders and correspondents of the entrepreneur.

Processing of Personal Data:
- “Representatives” (among others. employees, persons representing the entity/person, including proxies, persons appointed to contact or provide information or perform certain tasks) the following entities:
- contractors or potential contractors of the entrepreneur,
- organizational units, legal/physical persons or other types of entities cooperating with the entrepreneur on a basis other than a contract,
- entities from the entrepreneur’s business environment, other types of entities contacting the entrepreneur on any matter,
- personal data of persons who are correspondents in their own case, other than current or potential contractors.
- If you are a “representative” or a person referred to in this item II above, we process your personal data pursuant to Art. 6 Par. 1 Lit. (c) GDPR, in order to comply with legal obligations or pursuant to Art. 6 Par. 1 Lit. (f) GDPR, that is, for purposes arising from our legitimate interests in conducting our business, and this, depending on the circumstances of the case, among others. for:
- communication and handling of correspondence,
- to establish, or maintain contacts regarding the subject matter of the entrepreneur’s activity,
- to present an offer or consider an offer received, or otherwise establish cooperation,
- to conclude a contract and perform activities prior to its conclusion, such as: negotiations, exchange of documents,
- related to the execution of a contract concluded with a contractor,
- circulation of documents,
- to perform the required actions before the competent authorities,
- including public administration,
- establish or assert possible claims, or defend against such claims.
- If we have not obtained personal data directly from you, they come from the entity for which you act or a party to the contract concluded with the contractor, or from publicly available registers/databases, including the National Court Register, Central Register and Information on Economic Activity, Public Information Bulletin or websites.
If we obtain data by means other than directly from you, we may process the following categories of personal data: basic identification data, including first and last name, identification data granted by public authorities, electronic identification and location data, address data, contact data (e-mail address, telephone number), data concerning place of employment and position or function held, professional rights held, or other data provided to the entrepreneur in connection with cooperation or contact.
- We will keep personal data processed on the basis of the legitimate interest of the entrepreneur until it ceases, and in particular for the time necessary to secure information in the event of a legal need to prove facts or until the expiration of the statute of limitations for potential claims.
- Recipients of the data may be:
- persons authorized by us to process data in the performance of their official duties,
- other entities, if necessary, so that we can fulfill our obligations under the concluded contracts or the law, including the proper performance of the service, or exercise our rights,
- entities providing, among others postal and courier services, banks, insurers, tax advisors, law firms, entities to which we have outsourced services related to the processing of personal data,
- courts and public authorities to whom the entrepreneur is obliged or authorized to make your data available.
- You have the right to access your personal data, the right to request rectification or completion of your personal data, the right to request erasure of your personal data, in case of circumstances indicated in Art. 17 of the GDPR, the right to request restriction of processing of personal data, in cases indicated in Art. 18 of the GDPR, the right to portability of your personal data that we process by automated means on the basis of a contract or consent, the right to object, and the right to lodge a complaint with the supervisory authority in charge of personal data protection, i.e. the President of the Data Protection Authority. You have the right to object to the processing of your data for purposes arising from our legitimate interests. Providing data is voluntary, but necessary for the purpose for which the data are processed. In some cases, the provision of personal data is a statutory or contractual requirement. There will be no automated decision-making, including profiling, in the processing of your data. We do not transfer your data outside the EU/European Economic Area.
